These terms and conditions (“terms”) apply to your use of the website at ky-properties.com (the “website”), which is operated by KY Properties (“we”, “us”, “our”). Please read them carefully, particularly the sections on property information, advertising and our liability.
Acceptance of these terms
By accessing or using the website, submitting an enquiry or contacting us through the website, you agree to these terms. If you do not agree, please do not use the website.
You must be at least 18 years old to submit an enquiry. If you use the website on behalf of a company or another person, you confirm that you are authorised to do so.
About us
KY Properties is a real estate broker in the United Arab Emirates. We market off-plan and ready properties and help buyers and investors with enquiries, viewings, reservations and purchases.
We act as a broker and agent, not as a developer. We do not build or control the projects shown on the website. Each project’s developer is responsible for its design, construction, completion, quality and handover, and for the terms on which its units are sold. Where we market a ready property for its owner, the owner is the seller.
Using the website
You may use the website to find out about properties and to contact us, provided you do so lawfully and in line with these terms. We may update, suspend or withdraw all or part of the website at any time without notice. We do not guarantee that the website will always be available, uninterrupted or free from errors or viruses, so please use your own virus protection.
Property information
Property information on the website, including prices shown as “starting from”, payment plans, unit types, availability, handover dates, specifications and incentives, is provided by the developers of the projects we market (or, for some ready properties, by their owners). It is indicative only and subject to change without notice. In particular:
- Prices shown as “starting from” are the lowest prices provided to us for a project or unit type at the time of publishing. Units at that price may be limited or no longer available. Unless stated otherwise, prices are in UAE dirhams (AED) and may not include registration fees, service charges or other buying costs.
- Payment plans, unit types, sizes, layouts and floor plans are indicative and may be changed by the developer. Areas and measurements are approximate.
- Availability is not guaranteed. A unit is reserved only once the developer’s reservation process has been completed.
- Handover and completion dates are the developer’s estimates and may change.
- Specifications, finishes, amenities and facilities may change during design and construction.
- Incentives and offers, such as discounts, fee waivers or special payment plans, are set by the developer, may be available for a limited time only and are subject to the developer’s terms and eligibility rules.
Images, renders, computer-generated images, videos and virtual tours are artist’s impressions for illustration only. They may not reflect the final design, finishes, views or surroundings, and furniture and decoration shown are not normally included.
We take reasonable care to keep the website accurate and up to date, but we cannot guarantee that all information is complete, accurate or current. Before making any decision, please confirm the details with us and check them against the developer’s official documents.
No offer, contract or advice
Nothing on the website is an offer to sell, an invitation to buy or part of any contract, and nothing on it creates a binding obligation for you, us or any developer.
The website does not provide financial, investment, legal, tax or mortgage advice. Any figures about potential rental yields, returns or capital growth, and any statements about eligibility for mortgages, property ownership or residence visas, are general estimates or guidance only and are not guaranteed. Property values can go down as well as up. Before buying or investing, consider your own circumstances and seek independent professional advice.
Any purchase is subject to the developer’s reservation terms and sale and purchase agreement (SPA), and to registration with the relevant authority in the emirate where the property is located, such as the Sharjah Real Estate Registration Department in Sharjah or the Dubai Land Department and its Real Estate Regulatory Agency (RERA) in Dubai. If anything on the website differs from the SPA or the developer’s official documents, those documents prevail.
Our advertising
We advertise on platforms such as Facebook and Instagram (operated by Meta) and Google. Because ads are short, the information in them is summarised. Prices, payment plans, incentives and other details in our ads are subject to availability and to the developer’s terms, and may change after an ad is published.
If an ad differs from the website, the website prevails. In all cases, the developer’s official documents, including the SPA, prevail over both our ads and the website.
Some of our ads include lead forms on Meta or Google. Information you submit through these forms is handled as described in our privacy policy.
Enquiries and communications
When you submit an enquiry form or a lead form in one of our ads, or message us (including on WhatsApp), you agree that we may contact you by phone, WhatsApp, SMS and email about your enquiry and about other projects we reasonably believe may interest you. You also agree that we may share your enquiry with the developer of the relevant project, as explained in our privacy policy.
You can opt out of marketing messages at any time by replying STOP to our WhatsApp or SMS messages, using the unsubscribe link in our emails or emailing us at info@ky-properties.com.
Please make sure the information you give us is accurate and your own, and do not submit another person’s details without their permission. If you upload files, you confirm that you have the right to share them and that they do not contain viruses or other harmful code. Submitting an enquiry does not reserve a unit or commit you, us or any developer to a transaction.
Fair housing and non-discrimination
We are committed to treating everyone fairly. We do not discriminate against anyone in providing our services, including on the basis of race, colour, ethnic or national origin, nationality, religion or belief, sex, marital or family status, disability or any other characteristic protected by applicable law.
Some properties are subject to ownership rules set by law or by the relevant authorities, for example based on nationality. Intellectual property
The website and its content, including text, design, graphics, logos and the way the content is arranged, belong to KY Properties or our licensors and are protected by intellectual property laws.
Developer names, logos and trade marks, project names, renders, brochures and other developer materials belong to their respective owners. We use them to identify and market their projects. Their use on the website does not mean that we own them or that we are the developer.
You may view, download and print content from the website for your own personal, non-commercial use. You must not copy, republish, modify or distribute any content for commercial purposes, or use our name or logo, without our prior written permission.
Acceptable use
When using the website, you must not:
- Break any law or use the website for any fraudulent or unlawful purpose
- Submit false or misleading information, or impersonate any person or organisation
- Send spam, unsolicited advertising or bulk messages through our forms or contact channels
- Upload or transmit viruses, malware or any other harmful code
- Try to gain unauthorised access to the website, its servers or any connected systems, or interfere with how the website works
- Use bots, scrapers or other automated tools to copy or collect content or data from the website
- Upload content that is unlawful, offensive or defamatory, or that infringes anyone else’s rights
- Use our name, content or branding in a way that could mislead people, including in ads or on social media
We may restrict or block your access to the website, and delete your submissions, if we reasonably believe you have broken these terms.
Third-party websites and services
The website links to, and works with, services run by other organisations, such as developers’ websites, WhatsApp, Meta (Facebook and Instagram) and Google. We do not control these services and are not responsible for their content, availability or how they handle your information. Their own terms and privacy policies apply to your use of them, including WhatsApp’s when you contact us through WhatsApp, and a link to another website does not mean that we endorse it.
Limitation of liability
The website and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we give no warranties or promises about the website or its content, whether express or implied, and we are not liable for:
- Any loss arising from your reliance on information on the website or in our ads, including prices, payment plans, availability, handover dates, specifications, incentives or images
- Any act or omission of a developer, seller or other third party, including changes to a project, construction delays or failure to complete or hand over a property
- Any loss of profit, income, rental income, investment return, opportunity, data or goodwill, or any indirect or consequential loss
- Any loss or damage caused by viruses or other harmful material, or by the website being unavailable
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for fraud, or affects any rights you have as a consumer that cannot be waived.
Indemnity
You agree to indemnify KY Properties against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the website or any content you submit that infringes another person’s rights.
Privacy
Our privacy policy explains how we collect and use your personal data, including through our enquiry forms, cookies, the Meta Pixel and Google tags, and how you can control this. Please read it alongside these terms.
Changes to these terms
We may update these terms from time to time. We will publish the updated terms on this page and change the “Last updated” date at the top. If you continue to use the website after we change these terms, you accept the updated terms.
Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or your use of the website, are governed by the laws of the United Arab Emirates as applicable in the relevant emirate. The courts of the United Arab Emirates have exclusive jurisdiction over any such dispute. This does not affect any mandatory protections you may have under the laws of the country where you live.
General
If any part of these terms is found to be invalid or unenforceable, the rest will continue to apply. If we delay or do not enforce any of our rights, we can still enforce them later.
