This privacy policy explains how KY Properties collects, uses and shares your personal data when you visit our website, respond to our ads or contact us, and the choices you have, including how to control cookies and personalised advertising.
Who we are
KY Properties (“we”, “us”, “our”) is a real estate broker in the United Arab Emirates, marketing off-plan and ready properties. We are not the developer of the projects we market. We are the “controller” of the personal data described in this policy, and you can contact us at any time at info@ky-properties.com.
Scope of this policy
This policy covers personal data we collect through our website at ky-properties.com (the “website”) and its enquiry forms, through our ads and lead forms on Meta (Facebook and Instagram) and Google, and when you contact us by WhatsApp, phone or email. It does not cover services run by others, such as Meta, Google, WhatsApp or property developers, which have their own privacy policies. Your use of the website is also governed by our terms and conditions.
Information we collect
Information you give us
Our enquiry form collects:
- Your full name, email address and phone number (with country code)
- Whether you are an investor or an end user
- The project you are interested in
- Any message or files you choose to add (optional)
With each submission, we also record the page URL, the campaign parameters showing how you reached us (utm_source, utm_medium, utm_campaign, utm_term and utm_content), the gclid and fbclid click identifiers that Google and Meta add when you click through from their platforms, your IP address and your browser user agent. We use these to prevent spam and to see which ads lead to enquiries. Submissions are emailed to our team and stored in the website’s admin dashboard.
If you contact us by WhatsApp, phone or email, we collect your contact details, your WhatsApp profile name and photo (depending on your settings) and what you tell us, such as your budget or preferred unit type.
If you reserve or buy a property, we or the developer may need identity documents (such as your passport or Emirates ID), proof of address and source-of-funds information to meet “know your customer” requirements under applicable anti-money laundering laws. Please do not send identity documents or other sensitive information through our forms or messages unless we ask for them.
Information we collect automatically
When you visit the website, we and our partners use cookies, pixels and tags, subject to your cookie choices, to collect:
- Your IP address and approximate location
- Browser, device and operating system details
- Pages viewed, links and buttons clicked (such as our WhatsApp button) and form submissions
- The website, ad or campaign that referred you
- Cookie IDs and similar online identifiers
Information from advertising platforms and other sources
If you submit a lead form in one of our ads, the platform sends us your answers:
- Meta Lead Ads: instant forms in our Facebook and Instagram ads, which Meta may pre-fill from your profile (such as your name, email address and phone number), together with details of the ad you responded to.
- Google lead forms: lead forms in our Google ads, which Google may pre-fill from your Google Account.
Developers may also tell us about the progress of a reservation or purchase you make through us.
How we use your information
We use your personal data to:
- Respond to your enquiry by phone, WhatsApp, SMS or email
- Send you project information, such as prices, payment plans, availability and brochures
- Arrange viewings, reservations and purchases with the relevant developer
- Tell you about other projects and offers, unless you opt out (see “Marketing communications”)
- Measure our ads and show you relevant ads on other websites and apps (remarketing), in line with your cookie choices
- Understand how the website is used and improve it
- Keep the website secure and prevent spam, fraud and misuse
- Meet our legal obligations, including identity checks and record keeping under applicable anti-money laundering laws
- Establish, exercise or defend legal claims
Legal bases for using your information
In the UAE, we process personal data in line with Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). If you are in the European Economic Area (EEA) or the United Kingdom, the GDPR or UK GDPR may also apply. Depending on the activity and the applicable law, we rely on:
- Your consent, for example when you submit an enquiry, accept cookies or agree to marketing. You can withdraw consent at any time without affecting earlier processing.
- Taking steps at your request before a contract, or performing a contract, such as handling your enquiry, passing it to the developer and helping with a purchase.
- Our legal obligations, such as anti-money laundering checks and record keeping, and establishing or defending legal claims.
- Our legitimate interests, where the law recognises them (for example, under the GDPR), such as securing the website, preventing spam and improving our services, unless your rights override them.
Cookies and similar technologies
Cookies are small files stored on your device. Pixels, tags and similar technologies (such as local storage) record information or send it to us or our partners when a page loads or you take an action, such as submitting a form.
Third parties, including Google and Meta, may use cookies, web beacons and similar storage technologies to collect or receive information from our website and elsewhere on the internet, and use it to provide measurement services and target ads.
Types of cookies and tags we use
- Strictly necessary: needed for the website to work and stay secure, such as remembering your cookie choices. These cannot be switched off in our cookie settings.
- Analytics: Google Analytics 4 uses cookies to help us understand how visitors find and use the website. We may also use its advertising features, such as remarketing and demographics and interests reports, which combine this data with Google’s advertising cookies.
- Advertising: Google Ads conversion tracking and remarketing and the Meta Pixel measure whether our ads lead to enquiries and let us show you our ads on other websites and apps, such as YouTube, Facebook and Instagram. They may also send hashed (coded) contact details entered in our forms to Google and Meta for measurement (enhanced conversions and advanced matching). We may store, in your browser, the campaign parameters and click identifiers from the link that brought you to the website, to match a later enquiry to the right ad.
- Tag management: Google Tag Manager loads the tags above and applies your cookie choices to them. It does not set tracking cookies itself.
Cookies typically last from a single browsing session up to two years, unless you delete them sooner.
Your choices and Google Consent Mode
Where the law requires it, for example for visitors in the EEA and UK, we ask for your consent before using analytics and advertising cookies. When our cookie banner is enabled, these cookies and tags, including the Meta Pixel, follow the choices you make.
Google Consent Mode (version 2) tells Google’s tags whether you allow analytics and advertising cookies, the sending of your data to Google for advertising, and ad personalisation. If you decline, these tags do not use those cookies, but may still send limited cookieless signals (such as a page view or conversion) that Google may use for aggregate measurement and modelling.
You can change or withdraw your cookie choices at any time. Where our cookie banner is enabled, you can reopen your cookie settings below.
Opting out of personalised advertising
You can also use these tools:
- Google Ads Settings: manage or turn off personalised Google ads.
- Google Analytics opt-out browser add-on: stop Google Analytics measuring your visits.
- How Google uses information from sites or apps that use its services: learn how Google uses data from websites like ours.
- Meta ad preferences: control ads on Facebook and Instagram, including ads based on your activity elsewhere.
- Your Online Choices: opt out of interest-based ads from participating companies in Europe.
- Digital Advertising Alliance: opt out of interest-based ads from participating companies.
- Your browser settings: block or delete cookies, including third-party cookies. Blocking all cookies may affect how the website works.
Remarketing and custom audiences
We use remarketing to show our ads to people who have visited our website or interacted with our ads. Third-party vendors, including Google and Meta, show our ads on sites across the internet and use cookies to serve ads based on your past visits to our website.
We may also upload hashed (coded) contact details of people who have enquired with us to Google Customer Match and Meta Custom Audiences, so the platforms can match them to their users. We may use these audiences to show relevant ads to existing contacts, to exclude them from certain ads, or to reach people with similar characteristics (for example, Meta Lookalike Audiences).
We may also share limited conversion data with Google and Meta, such as a click identifier and whether an enquiry or sale followed, to measure how well our ads work.
To opt out, use the tools above or email us at info@ky-properties.com to be removed from the customer lists we upload.
How we share your information
We share personal data only as needed for the purposes in this policy, with:
- The developer of the project you enquired about (for example, Azizi Developments for Azizi Florence) or, for ready properties, the seller or their agent, so they can provide information, arrange viewings and handle reservations and sales. They use your data under their own privacy policies.
- Service providers, such as our web host, our email (SMTP) provider and IT, security and messaging providers (including WhatsApp, operated by Meta), who may use your data only to provide their services to us.
- Advertising and analytics partners, such as Google and Meta, as described above.
- People you ask us to introduce you to, such as a mortgage adviser, bank or conveyancer.
- Professional advisers, such as lawyers, accountants and auditors.
- Regulators, courts, law enforcement and other authorities, including real estate registration authorities, where the law requires or permits it, for example under applicable anti-money laundering laws.
- A buyer or successor if our business is sold, merged or reorganised, who may use your data only in line with this policy.
We do not sell your personal data.
International transfers
Google, Meta and our hosting and email providers may process personal data outside the UAE, for example in the European Union or the United States. When we transfer personal data internationally, we protect it as required by applicable law, for example through contractual safeguards or, where appropriate, your consent.
How long we keep your information
We keep personal data only as long as we need it:
- Enquiries and related messages: up to 24 months after our last contact, unless you become a client, a transaction is in progress or the law requires longer.
- Reservation, purchase and identity records: for the period required by law, including anti-money laundering record-keeping rules.
- Marketing opt-outs: a minimal record, so that we can respect your request.
- Cookie and advertising data: as described above and in line with Google’s and Meta’s retention settings.
We then delete or anonymise the data.
How we protect your information
We use appropriate technical and organisational measures to protect your personal data, including limiting access to people who need it and using reputable service providers. No internet transmission is completely secure, so we cannot guarantee the security of data you send us. If a breach affects your data, we will notify you and the authorities where the law requires.
Your rights
Depending on the law that applies to you (including the PDPL, GDPR and UK GDPR), you may have the right to:
- Access your personal data and receive a copy
- Correct inaccurate or incomplete data
- Ask us to delete your data
- Restrict how we use your data
- Object to our use of your data, including for direct marketing
- Receive your data in a portable format or have it transferred to another organisation
- Withdraw your consent at any time
- Opt out of marketing
- Complain to the UAE Data Office or the data protection authority where you live or work
Some rights have limits; for example, we may need to keep records required by anti-money laundering laws. To exercise your rights, email us at info@ky-properties.com. We may need to verify your identity, and we will respond within the time required by law, normally free of charge.
Marketing communications
With your agreement, or where the law otherwise allows, we may send you information about the project you enquired about and other projects and offers by phone, WhatsApp, SMS or email. You can opt out at any time by:
- Replying STOP to any WhatsApp or SMS message
- Using the unsubscribe link in any marketing email
- Emailing us at info@ky-properties.com or telling us during a call
Even after you opt out, we may still contact you about an active enquiry or transaction.
Children
The website and our services are not directed at anyone under 18, and we do not knowingly collect their personal data. If you believe a child has given us personal data, contact us at info@ky-properties.com and we will delete it.
Third-party websites and services
The website links to, and includes features from, other services, such as developers’ websites, WhatsApp, Meta and Google, and may include embedded content such as videos or maps. These services handle your data under their own terms and privacy policies, and we are not responsible for their practices. For example, messages sent through our WhatsApp button are handled by WhatsApp, which is operated by Meta.
Automated decision-making
We do not make decisions about you based solely on automated processing that have legal or similarly significant effects. Advertising platforms use automated systems to choose which ads to show, but this does not have such effects.
Changes to this policy
We may update this policy from time to time. We will publish changes on this page and update the “Last updated” date, and we will take reasonable steps to tell you about significant changes, such as a notice on the website.
